1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website operated by Importapart, LLC ("Importapart," "we," "us," or "our"), including importapart.com (the "Site") and any purchases made through it.

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

2. Eligibility

You must be at least 18 years old to make a purchase on this Site. By placing an order, you represent that you are at least 18 and have the legal capacity to enter into a binding contract.

3. Products and Pricing

We sell used and aftermarket automotive parts. All parts are sold as described in the product listing.

We do our best to accurately describe each part, including condition, fitment, and any known defects, but we cannot guarantee that all listings are free of errors. If a product description, price, or availability is incorrect, we reserve the right to cancel any order placed on incorrect information and issue a full refund.

Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to modify or discontinue any product at any time.

4. Order Acceptance

Your order is an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

If we cancel your order after payment has been processed, we will issue a full refund to your original payment method.

5. Fitment Information

Customers are responsible for verifying that a part fits their specific vehicle before purchasing. We provide year, make, model, and other fitment information to help, but it is the customer's responsibility to confirm the part is correct for their application. Returns for fitment issues are subject to our Return & Refund Policy.

6. ECU, ECM, and PCM Programming

Some products require programming before installation. When you purchase a programmed module, you must provide accurate Vehicle Identification Number (VIN), odometer reading, and current part number information at checkout. We program the module based on the information you provide.

If you provide incorrect information, the module may not function correctly in your vehicle. We are not responsible for programming errors caused by incorrect customer-supplied information.

If you select "Don't need it programmed" at checkout, you represent that you or your repair facility have the ability to program the module yourselves. Unprogrammed modules are sold as-is and are not eligible for return based on programming, compatibility, or fitment issues.

7. Payment

We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us to charge the full amount of your order, including any applicable taxes and shipping fees.

8. Shipping and Delivery

We ship to all 50 U.S. states. We do not ship to PO Boxes or outside the United States. Shipping costs, delivery times, and any restrictions on specific items are described in our Shipping Policy.

Risk of loss and title for items pass to you upon delivery to the carrier.

9. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

10. Warranty

Parts purchased from Importapart are covered by a 60-day limited warranty against defects from the date of delivery. Full warranty terms — including what is and is not covered, and how to file a claim — are described in our Warranty section of the Return & Refund Policy.

This is the only warranty Importapart provides. To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Importapart, LLC, its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, vehicle damage, towing costs, rental car expenses, or labor costs related to installation or removal of any part purchased from us.

Our total liability for any claim arising out of or relating to these Terms or any product purchased from us will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

12. Installation Disclaimer

Automotive repair can be dangerous if performed incorrectly. Parts purchased from Importapart should be installed by a qualified mechanic or someone with the appropriate skills, tools, and knowledge. We are not responsible for damages, injuries, or losses resulting from improper installation or use of our products.

13. Intellectual Property

All content on the Site, including text, graphics, logos, images, and product descriptions written by Importapart, is owned by or licensed to Importapart, LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our written permission.

14. User Conduct

You agree not to use the Site to:

Violate any applicable law or regulation
Submit false, misleading, or fraudulent information
Interfere with the operation of the Site or attempt to gain unauthorized access to our systems
Use automated means (bots, scrapers, etc.) to access the Site without our written permission
Resell or redistribute products purchased from us in a manner that violates manufacturer restrictions or applicable law

15. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content or practices of those sites and including a link does not imply our endorsement.

16. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

17. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page with the "Last updated" date at the top. Continued use of the Site after changes are posted means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to the personal jurisdiction of those courts.
